麦当劳卖咖哩
以前听过这个案，但没有“经手”写过这个案，今天同事看网上新闻，知道这个案终于有“最后”的结果！
长话短说之~麦记叔叔不爽卖咖哩的用它的麦记（MC)作为店名，所以就叫大状去告卖咖哩的，第一回合的时候本来麦叔叔胜的，但是卖咖哩的不认输，第二回合应该是胜出了，麦记想作最后的努力的，只是不得要领，所以卖咖哩的可说是守得“麦”开见“咖哩”了！呵呵！

McCurry wins battle to use "Mc"2009/09/08
PUTRAJAYA: World fast food chain McDonald's has lost the battle to stop local Indian restaurant McCurry Restaurant (KL) Sdn Bhd from using the "Mc" trademark.
In announcing a unanimous decision today, the Federal Court also ordered McDonald's to pay RM10,000 cost to McCurry which has an outlet in Jalan Ipoh in Kuala Lumpur.
"Our view is that the questions posed by McDonald's were not properly framed and the court should dismiss the leave application," said Chief Judge of Malaya Tan Sri Arifin Zakaria who sat with Federal Court Judges Datuk Wira Mohd Ghazali Mohd Yusoff and Datuk James Foong.
The court adjourned the case yesterday after finding questions raised by Mcdonald's lawyers were unclear and asked that they be rephrased. McDonald's filed a leave application to appeal after the Court of Appeal on April 29 ruled it was wrong to assume that McDonald's had a monopoly on the use of the prefix ''Mc''.
A High Court had earlier ruled in favour of McDonald's but McCurry took the fight to the Court of Appeal.
During the court hearings, McCurry contended that McDonald's could not claim monopoly or exclusive rights to the use of "Mc" as that prefix was extensively used around the world as surnames, particularly by people of Scottish origin.

既然Mc不是麦当劳“专有”的，以后是不是除了“卖咖哩”，其他人也可以任用，比如“卖拉沙”、“卖东炎”、Mc这Mc那！
名字这东西，有些喜欢你任用，有些要说是自己专有，有些要注册占为己用，否则被盗用！真难搞！
孤陋寡闻的自己如果不是这个案件，根本不知道有“卖咖哩”这间东西，看来这间“卖咖哩”这次不只是胜了麦当劳，案件也间接替它打了广告。
P/S：题目看似麦当劳在卖咖哩，其实案件是麦当劳 Vs 卖咖哩！！哈！

哈哈。。今早我也看到网上新闻。。还蛮搞笑的。。都是‘麦’字惹的祸。。
这种有点像是‘被沾光妄想症’；幸亏没有牵扯到麦加和麦片虾。。如果被牵拖成功的话，我可能就要去麦当当吃海鲜了。。
